Terms of Service

About the service

Grøfteplan.no is a digital tool for creating outline sketches for trench work. It is not a design or engineering tool. Users are responsible for ensuring that plans are reviewed by qualified personnel and comply with applicable laws, regulations and requirements.

Subscription

• All subscriptions include a 7-day free trial. Payment details are collected at the start of the trial.
• After the trial, your subscription renews automatically every month.
• Moldskred Evo Technology is not registered for VAT, so no VAT is added to the prices. Prices may be adjusted with 30 days' notice.

Team subscriptions

• A team subscription is purchased by an organisation. The purchaser is the team owner and customer, and is responsible for payment and for how the service is used in the team. Users added to the team use the service through the team owner's subscription and are bound by these terms.
• The team owner can invite as many users as the subscription covers (the team owner counts as one user), and can remove users at any time.
• Plans created in the team belong to the team and the organisation. Everyone in the team can view and edit them, and the team owner and team admins can delete them. A user who is removed loses access to the team plans, including those they created themselves.
• The team owner must have a basis for adding the users and must inform them that plans they create in the team are shared with the team and belong to the organisation.
• If the team subscription ends, everyone in the team loses access when the period expires. Team plans are kept for 12 months before they are deleted, and the team owner receives an email notice 30 days before. If the team is deleted, each team plan becomes a personal plan for the person who created it.
• The team owner can ask for ownership to be transferred to another user in the team. If the team owner is no longer available, for example because they have left the organisation, the organisation can ask Moldskred Evo Technology to transfer ownership. The request must come from someone authorised to represent the organisation, and we will verify it before the transfer is made.

Cancellation

Right of withdrawal

For new subscriptions, you consent to Grøfteplan beginning delivery of the service immediately. This means your right of withdrawal lapses pursuant to the Norwegian Right of Withdrawal Act § 22 lit. n. You provide this consent explicitly at the time of each purchase. For subscriptions entered into without such consent, the statutory 14-day right of withdrawal from the date of agreement applies — contact us at support@grofteplan.no within the deadline, stating your name, contact details and what you wish to withdraw from.

Complaints

If you have questions or complaints about the service, contact us at support@grofteplan.no. We aim to handle complaints promptly, normally within a few business days. If you are not satisfied with our response, you may lodge a complaint with the Norwegian Consumer Authority (forbrukertilsynet.no) or use the European Commission's online dispute resolution platform (ec.europa.eu/odr).

Disclaimer of liability

Moldskred Evo Technology is not liable for errors or deficiencies in plans created with the service, any loss or damage arising directly or indirectly from use of the service, or for service interruptions beyond our control. The service is provided 'as is' without warranty of fitness for a particular purpose.

Intellectual property

You own your own plans and data. Team plans belong to the organisation that owns the team. Grøfteplan.no has no right to use the plans for purposes other than providing the service. The software and service belong to Moldskred Evo Technology.

Data processing terms for teams

• When an organisation uses a team subscription, the organisation is the data controller for the personal data in team plans (e.g. names and signatures of workers and responsible persons) and for the information about the users in the team. Moldskred Evo Technology is the data processor. These terms constitute the data processing agreement between the parties, cf. Article 28 of the General Data Protection Regulation.
• Purpose and duration: We process the data only to provide the service (storage, synchronisation, sharing within the team, PDF, invitations and notices) and only on documented instructions from the organisation, which are these terms and the settings the organisation makes in the service. The agreement applies for as long as we store team data.
• Types of data and data subjects: contact details (email) and role for the users in the team, and names, signatures and other information the organisation enters in plans about employees, subcontractors and other persons. The same applies to the contact persons users add to the contact list: name, email address, phone number, role and company.
• Security and confidentiality: We are bound by confidentiality and ensure that everyone with access is too. Data is encrypted in transit and at rest, access is restricted by row-level access control, and only necessary personnel have access.
• Sub-processors: The organisation gives general authorisation to the sub-processors listed in section 5 of the Privacy Policy. We give at least 30 days' notice of new or changed sub-processors, and the organisation may object and terminate the agreement.
• Assistance and incidents: We help the organisation respond to requests from data subjects and with its obligations under Articles 32–36. Personal data breaches are notified without undue delay after we become aware of them.
• Deletion and audit: When the subscription ends, team data is deleted according to the time limits in the Privacy Policy (12 months, with notice 30 days before), or earlier if the organisation requests it. The organisation can export the plans as PDF before then. We make available the information needed to demonstrate compliance with these obligations and facilitate audits by agreement. Contact persons in the contact list are stored until they are deleted: personal contacts by the user, team contacts by the team owner or a team admin. Personal contacts are also deleted together with the account. If the team is deleted, the team contacts become personal contacts of the team owner.

Language

These terms are available in several languages. If the language versions differ, the Norwegian text (Nynorsk and Bokmål) prevails.
